Terms of Service

Service

- FictCo provides web hosting and email services to its Customers. The terms of this service may be found at http://support.fictco.com/terms_of_service/terms_of_service.html and may be updated at any time, without notice.

- The Customer is responsible for keeping current backups of all Customer-owned files that are stored on FictCo's servers. FictCo will attempt to maintain current backups of its servers but is not responsible for damages that arise from the loss of any Customer-owned data.

- FictCo will make every effort to ensure that its servers are available at all times. However, the Internet does sometimes experience outages and FictCo can not guarantee connectivity to networks outside of its control.

- If services are down for a significant period of time, the Customer will be offered a refund for that downtime.


Liability

- FictCo makes no warranties of any kind, expressed or implied, for the service it is providing. Fictco also disclaims any warranty of merchantability or fitness for a particular purpose. Fictco will not be responsible for any damages the Customer may suffer. This includes loss of data resulting from delays, nondeliveries, misdeliveries or service interruptions caused by the negligence of the Customer or of Fictco, errors or omissions, or due to inadvertent release or disclosure of information sent by the Customer.


Acceptable Use

- The Customer may use the services provided by FictCo for any lawful or legal activity. FictCo does not monitor the content of its Customers and is not responsible for the content that is placed on its servers by the Customer.

- FictCo expects that its Customers will be courteous Internet citizens. As such, mail abuse (including, but not limited to, the sending of spam) and network abuse (including, but not limited to, the launching of denial of service attacks) are strictly prohibited. Additionally, any use which interferes with the ability of the server to perform its web hosting and email delivery services is also prohibited.


Billing

- The Customer must maintain current and accurate contact information with FictCo for the purposes of billing, technical and customer service.

- Fictco bills its accounts in advance in quarterly, biannual or annual cycles. Payment for accounts is due by the date indicated on the invoice and an account that is not paid by the date indicated on the invoice may be suspended until payment is received. Suspended accounts will continue to incur monthly charges. To re-activate a suspended account, the Customer must pay all outstanding charges on that account.


Termination

- Unless otherwise noted, Customers are on a month-to-month contract with Fictco.

- The Customer may terminate this agreement at any time by notifying Fictco at least 15 days before the end of the calendar month. The Customer's account will remain active for the remainder of the month and at the end of the month, FictCo will refund the Customer for the remainder of the pre-paid amount and de-activate the account.

- FictCo can cancel a Customer account at any time for violation of this agreement. If FictCo cancels a Customer account for reasons other than a violation of these terms, the Customer will be refunded the unused amount paid for hosting services. No refund will be issued if the Customer has violated the terms of this agreement.
